this one is tricky, I don't know the true time it was determined but originally it was considered a fruit by the gov't, this was due to a tariff on fruits but not on vegetables. canned tomatoes were one of the biggest imports and it was considered a fruit so the gov't could collect their money.

Tomato is a fruit , it is called as vegetable because tomato is the only fruit that can be cooked with other vegetables. so it can be said as fruit as well as vegetable.
It is hard for us to find a banana to be cooked with onion, drumstick or custard etc .. same case for pineapple,apple ,grapes ,orange , berries etc ... whether its Indian food or Mexican or Italian cusine this formula is applicable for all .

I consider them vegitables. The "tomatoes have seeds so they're a fruit" argument is retarded. People grow tomatoes in their "vegitable gardens" and I have never seen a fruit salad with tomatoes in it!

Technically speaking its a fruit. In the court case Nix v. Hedden the Tomato was classified as a vegetable, also the USDA classifies the tomato as a vegetable. However by scientific definition the tomato is a fruit even though it is considered by most as a vegetable.
