My M+Ms melted in my hand while in a warm country, not in my mouth ... can I sue?!


Question: I was told they would melt in my mouth and not in my hand, but low and behold, I was eating some, and the chocolate melted in the palm of my hand, causing me much stress and anxiety

could I have a case against the makers of m+ms, masterfood I believe?

that's a really stupid reason to sue

It's not something you can sue for.... what is the damage you have suffered? Emotional trauma? What price is the pain you've experienced worth? HOWEVER it is false advertising, so you can report them to the government agency and consumer groups. That being said, most companies their size have a customer service number which you can call and they tend to refund the purchase or send you free replacements if you're not totally satisfied.

It is not advisable to sue for that reason as the court will most likely trash it.
Just out of curiosity, where were you?

Sue what? are you willing to spend that much? or just buy another one and keep it in the ref.

i dont think thats their slogan...plus they don't guarantee it... so you might not be able to win that case..

Only problem is the legal maxim "de minimis non curat lex" meaning the Law doesn't bother about little things.
